NOTIFICATION OF ENVIRONMENTAL AUTHORISATION

(DEA&DP Ref No: E12/2/3/1-A5/235-0118/06)

 

We hereby advise you that the Department of Environmental Affairs and Development Planning (DEA&DP) has granted an Environmental Authorisation with conditions for the above-mentioned project in terms of the National Environment Management Act (No. 107 of 1998).  

 


The activities listed under the regulations form part of the development of Leopard Rock Estate on Erf 840, 842, 2223 & 2829 on the southern side of Marais Road in Scott Estate, Hout Bay as a medium density residential estate.  The Estate will consist of approximately 14 single residential properties and will include a private and public road as well as the upgrading of the stormwater system and outfall into the Disa River.

 

REASONS FOR THE DECISION

In reaching its decision, the Department took, inter alia, the following into consideration:

 

       Information contained in the Notice of Intent, the Application Form and Final Basic Assessment Report

    Comments from Cape Nature; City of Cape Town: South Peninsula Administration; registered I&AP’s, relevant information contained in the Departmental information base; and the objectives and requirements of relevant legislation, policies and guidelines of the National Environmental Management Act (Act No 107 of 1998).

    

     A summary of the most significant issues which were considered includes:

  •  Environment

The site is a derelict residential property with no significant indigenous species in any number, and is not regarded valuable from a conservation point of view.  A significant granite outcrop and associated vegetation is located outside of the southern boundary of the site.

  • Socio-economic

     The proposed site is surrounded by medium density properties with single residential zoning in a well-established area, supporting medium to high income groups.  It is expected that ± 70% of the unskilled labour force can be employed from the local community and that unemployed and previously disadvantaged persons will be trained during the project.

  •  Policy: Regional/planning context

     The site is demarcated for Urban Development purposes, therefore the proposed residential use is in line with the Urban Structure Plan.

  • Visual impacts

     The applicant will ensure that the development will not be visually obtrusive and will be responsive to the natural environment and semi-rural quality of the valley.

  • NEMA Principles

     The Department adopted an integrated approach during its decision-making by taking cognisance of the three pillars of sustainable development (biophysical, social and economic).

  • Alternatives

     Three alternatives were evaluated; including the “No Development” option and 2 layout options.  No alternatives for the alignment of the stormwater pipe were considered as the only practical option is the existing servitude that runs down Scott Road.

  • Public Participation

     The Directorate is satisfied that the public participation process followed met the necessary legal requirements and that the aforementioned issues were addressed adequately in the Basic Assessment Report and EMP.

The Directorate is satisfied that, subject to compliance with the conditions contained in the Environmental Authorisation, the proposed activity will not conflict with the general objectives of integrated environmental management laid down in Chapter 5 of the National Environmental Management Act, 1998 (Act No 107, of 1998) and that any potentially detrimental environmental impacts resulting from the proposed activity can be mitigated to acceptable levels.

Your attention is drawn to your right to lodge a formal appeal with the Minister.  Any person who wishes to appeal against the Environmental Authorisation must lodge a Notice of Intention to Appeal with the Minister within 10 days of receiving this notice, and serve a copy of the Notice on the applicant as well as a notice indicating that the appeal submission will be available within 30 days of lodging the Notice of Intention to Appeal.

NOTIFICATION OF THE AVAILABILITY OF THE FINAL BASIC ASSESSMENT REPORT
(DEA&DP Ref No: E12/2/3/1-A5/235-0118/06)

The Draft Basic Assessment Report (BAR) for the above mentioned project was made available for public comment as part of the Public Participation process, in term of the NEMA Environmental Impact Assessment Regulations 2006, from the 25 March to the 24 April 2008.

The draft BAR has now been updated to include the comments received from Interested and Affected Parties (I&AP’s) during this period.

The final BAR has been made available from the 26 May 2008 for information purposes at the following locations:

I&AP Notification Letters - Availability of Final BAR

We hereby inform you that the final Basic Assessment Report (BAR) has also been submitted to the Department of Environmental Affairs & Development Planning (DEA&DP)

BASIC ENVIRONMENTAL ASSESSMENT PROCESS
(DEA&DP Ref No: E12/2/3/1-A4178 - 0385/07)

It is proposed that Erf 1260, Gaylee Extension 6, be developed as a town housing development consisting of 105 residential erven, 3 portions of private open space and the remainder private road. The site is 2,4676ha in extent, currently vacant and un-utilized. The erf is overgrown with alien vegetation and used as a shortcut between Albert Philander Road and Franschoek Road.
The NEMA EIA regulations require that a Basic Environmental Assessment be undertaken for a development of this nature. Planning in Balance has been appointed to conduct the Basic Assessment which has a Public Participation component.

Project Status:

We hereby advise that the Department of Environmental Affairs and Development Planning (DEA&DP) has granted an Environmental Authorisation with conditions to Shearwater Homes (Pty) Ltd for the above-mentioned project in terms of the National Environment Management Act (No. 107 of 1998). The following listed activity may now take place within 2 years from the date of authorisation:

  • 15. The construction of a road that is wider than 4 metres or that has a reserve wider than 6 metres, excluding roads that fall within the ambit of another listed activity or which are access roads of less than 30 metres long.

This activity forms part of the proposed development of a townhouse complex on Erf 1260, consisting of 99 single residential erven, 2.1 parking bays per unit, 3 portions of private open space and a private road.

The Directorate is satisfied that, subject to compliance with the conditions contained in the Environmental Authorisation, the proposed activity will not conflict with the general objectives of integrated environmental management laid down in Chapter 5 of the National Environmental Management Act, 1998 (Act No 107, of 1998) and that any potentially detrimental environmental impacts resulting from the proposed activity can be mitigated to acceptable levels.
